Highway Defect Accident and Personal Injury Lawyer

Personal Injury Caused by Bad Roads

Bad Design Can Lead to Bad Accidents

Highways are designed by traffic and safety engineers charged with the task of moving traffic quickly and safely. When highways are not properly designed or are not maintained in accordance to those designs, they can contribute to traffic accidents.

In my 30 years as an attorney, I have handled a number of highway defect cases, and litigated the largest recovery of the year against the Georgia Department of Transportation (GDOT). Government, state, counties and municipalities can all be held liable and are not necessarily subject to sovereign immunity.

Your Accident May Not Be Your Fault

A driver's loss of control can happen for many reasons, none of which is necessarily the driver's fault:

  • Roadways with uneven shoulders and ditches, including country roads with no curbs. These can adversely affect a driver's ability to drive onto shoulder safely or drive safely back onto roadway.
  • Ditches with drop-offs as high as 6-8 inches, making it impossible to climb back onto the pavement safely. You may have to turn your wheels to such a degree, you have no time to correct, and you have no choice but to cross the center line.
  • Inadequate signage. In some rural counties, they don't have the budget to properly sign the roadways. If a sign is knocked down or stolen, it can result in dangerous driving conditions: especially if it was a stop sign.
  • Curve signs. If you are on a 50 mph highway and a curve is not properly signed you may not be able to successfully negotiate it and could end up in ditch or hit oncoming traffic.

Highway traffic accidents are complex and these cases need a lawyer with knowledge and experience in Georgia laws.
